Important: DNC Guard is a documentation and filing assistance tool. We are not a law firm and do not provide legal advice. Nothing in this app constitutes legal advice. Consult a licensed attorney for advice specific to your situation.

1. Acceptance of Terms

By downloading or using DNC Guard, you agree to these Terms of Service. If you do not agree, do not use the app.

2. What DNC Guard Does

Helps you register on federal and state Do Not Call registries via links to official government websites
Allows you to document and log incoming calls that may violate Do Not Call laws
Generates pre-filled complaint forms for the FTC, FCC, and state consumer protection agencies
Generates pre-filled small claims court filings for eligible violations
Connects you with consumer rights attorneys (referral service only)

3. What DNC Guard Does NOT Do

Does not provide legal advice or legal representation
Does not guarantee any outcome in complaints or lawsuits
Does not automatically file complaints without your explicit action
Does not automatically contact any government website on your behalf
Does not guarantee that all flagged calls are legally actionable violations

4. User Responsibilities

Provide accurate and truthful information in your profile and filings
Verify you are registered on the DNC Registry before filing complaints
Comply with your state's call recording laws before recording any calls
Not use DNC Guard to file false, fraudulent, or malicious complaints
Use the app only for lawful purposes

5. Subscription & Payments

Monthly Plan ($2.99/month): Billed monthly through Apple App Store or Google Play. Cancel anytime through your app store account settings. No refunds for partial months. Apple and Google take 30% of subscription revenue in year 1, 15% thereafter.

DNC Guard does not store payment card information. All payments processed by Apple or Google.

6. Attorney Referral Disclaimer

The attorney referral feature connects you with independent consumer rights attorneys. DNC Guard does not employ these attorneys and is not responsible for outcomes. DNC Guard may receive a referral fee from participating attorneys.

7. Disclaimer of Warranties

DNC Guard is provided "as is." We do not warrant that any complaint will result in enforcement action or that any lawsuit will be successful. Legal information in the app may not be current or applicable to your specific situation.

8. Limitation of Liability

To the maximum extent permitted by law, DNC Guard shall not be liable for any indirect, incidental, or consequential damages. Our maximum liability shall not exceed the amount you paid in the 12 months preceding the claim.

9. Governing Law

These Terms are governed by the laws of the State of New Jersey. Any disputes shall be resolved in the courts of New Jersey.
